[81] Gabriel Kojima, a Certified Forensic Examiner, was retained by the Secure Defendants to provide assistance in relation to electronic evidence. He was asked to look at Higham’s home and office computers in relation to these e-mails. Kojima confirmed that they were deleted; however, he could not say when. He also deposed that there was no evidence on these computers that the e-mails were ever opened. The Plaintiff points out that Higham’s Shaw account was not reviewed and that these e-mails could have been downloaded on any computer.
